What Is an Unmarried Partner Visa?

An unmarried partner visa is a route under Appendix FM of the Immigration Rules that allows a person in a long-term, committed relationship to join a British citizen or settled person in the UK. The relationship must be genuine, subsisting, and akin to marriage, meaning it carries the same level of commitment, even though the couple have not married or entered a civil partnership.

The key distinction from a spouse visa is that instead of providing a marriage certificate, an unmarried partner visa applicant must demonstrate a two-year relationship that is equivalent to marriage in its depth and commitment. After meeting this requirement, all other eligibility criteria are identical to the spouse visa route.

Who Can Apply for an Unmarried Partner Visa?

You (the applicant) can apply if you meet all of the following conditions.

  • Age: You and your partner must be at least 18 years old at the date of application.
  • Valid sponsor: Your partner (the sponsor) must a British citizen, a person with Indefinite Leave to Remain or Pre-Settled Status under the EU Settlement Scheme
  • Two-year relationship akin to marriage: You must have been in a genuine and subsisting relationship with your partner for at least two years, and that relationship must be akin to marriage in its nature and commitment.
  • Not married to another person: Neither you nor your partner can be legally married to, or in a civil partnership with, someone else. Any previous relationships must have permanently broken down.
  • Met in person: Your relationship cannot have been conducted entirely online or by telephone. You must have met face to face.
  • Financial requirement: You and/or your sponsor must meet the £29,000 income threshold.
  • English language: CEFR A1 level or exempt.
  • Accommodation: Suitable accommodation in the UK.
  • Good character: No serious criminal convictions or immigration violations.

The Two-Year Relationship Requirement

The defining requirement for an unmarried partner visa is that you must have been in a genuine and subsisting relationship akin to marriage for at least two years at the date of application. There are two ways to satisfy this requirement.

If You Live Together

If you and your partner have lived together as a couple for at least two continuous years immediately before the application date, this is the most straightforward way to demonstrate your relationship. Joint tenancy agreements, joint council tax records, joint utility bills, and correspondence addressed to both of you at the same property provide strong evidence of cohabitation.

If You Do Not Live Together

Cohabitation is not mandatory. If you and your partner have been in a relationship for at least two years but have been unable to live together, for example, because of work commitments, study obligations, cultural or religious reasons, or immigration restrictions, you can still apply for an unmarried partner visa.

Where you do not live together, you must demonstrate that your relationship is genuine and subsisting through evidence of ongoing commitment. The Home Office guidance specifies four categories of evidence:

  1. Regular communication: Evidence of consistent, ongoing contact, messages, video calls, letters, emails, and social media communication throughout the two-year period.
  2. Financial support: Evidence that one partner has financially supported the other, or that you share financial responsibilities, bank transfers, joint contributions to shared costs, or evidence of financial interdependence.
  3. Caring for shared children: If you have children together, evidence that you share parenting responsibilities.
  4. Spending time together: Evidence that you have spent time together in person, travel records, flight bookings, photographs together, hotel receipts, and passport stamps showing visits.

The key principle is that despite not cohabiting, you must show that your relationship has the depth, continuity, and commitment of a married couple.

Relationship and Cohabitation Evidence

Strongest Evidence (Living Together)

  • Joint tenancy agreement or mortgage in both names
  • Joint council tax registration
  • Joint utility bills (gas, electricity, water, broadband) spanning the two-year period
  • Joint bank account statements showing shared finances
  • Correspondence from official bodies (HMRC, NHS, local council) addressed to both partners at the same address

Evidence for Couples Who Do Not Live Together

  • Communication records (WhatsApp, email, video call logs) showing regular, sustained contact
  • Bank statements showing financial transfers between partners
  • Flight bookings, boarding passes, passport stamps, and travel itineraries showing visits
  • Photographs together during visits, with date metadata or captions
  • Hotel or accommodation receipts during visits
  • Evidence of shared parenting responsibilities (if applicable)
  • Evidence of engagement or plans for a shared future

Supplementary Evidence (All Couples)

  • Photographs together throughout the relationship, showing progression over time
  • Social media posts, tags, and shared albums
  • Joint insurance policies (home, vehicle, travel, pet)
  • Joint loans or credit agreements
  • Evidence of travel together as a couple

The Financial Requirement: £29,000 Annual Income

The £29,000 Income Threshold

The minimum income requirement (MIR) for an unmarried partner visa is £29,000 gross per year. This threshold applies to all new applicants from 11 April 2024.

Transitional arrangements: If the applicant was already on the partner route before 11 April 2024, the previous threshold of £18,600 applies, subject to a cap of £29,000. Additional amounts apply for dependent children: £3,800 for the first child and £2,400 for each additional child.

The Savings Alternative

If the sponsor’s income is below £29,000, savings held for at least six months can supplement or replace income. The formula is:

(Savings − £16,000) ÷ 2.5 = additional annual income recognised

To meet the £29,000 threshold entirely through savings, the sponsor would need £88,500 held in an accessible account for at least six months before the application date.

Disability Benefits Exemption

Sponsors receiving certain disability-related benefits are exempt from the minimum income requirement entirely. Where the exemption applies, the financial requirement is replaced by the adequate maintenance test: the family’s net income, after housing costs, must be at least equal to the Income Support equivalent for their household.

The English Language Requirement: CEFR A1 Level

The applicant must demonstrate English language ability at CEFR A1 level (entry level) for the initial application, this can be done in the following ways:

  • Approved SELT test: Take a Secure English Language Test from an approved provider (Trinity College London, IELTS for UKVI, LanguageCert, or Pearson PTE Academic UKVI). 
  • Academic qualification: Hold a degree or equivalent taught in English, verified by UK ENIC.

Nationals of majority English-speaking countries (Australia, Canada, New Zealand, USA, Ireland, etc.) are exempt. Applicants aged 65 or over are exempt.

Accommodation Requirement

The sponsor must demonstrate that adequate accommodation is available for the applicant, the sponsor, and any dependants, without overcrowding. The property must be owned or legally occupied, not overcrowded under the Housing Act 1985 standards, and exclusively available for the family’s use.

Evidence required: tenancy agreement or proof of ownership, council tax registration, utility bills showing the property address, and landlord’s confirmation (if renting).

Tuberculosis Test

Applicants from countries where tuberculosis is endemic, including India, Pakistan, Bangladesh, Nigeria, and many others, must provide a TB test certificate. This involves a chest X-ray at a Home Office-approved clinic before submitting the visa application. The certificate is valid for six months.

How to Apply for an Unmarried Partner Visa

Step 1: Prepare Your Documents

Gather all required supporting documents: personal documents (passport, birth certificate, divorce decrees if applicable), relationship evidence, financial evidence (sponsor’s payslips, P60 or tax return, employer letter, bank statements, savings evidence), English language evidence, accommodation evidence, and health (TB test certificate).

Step 2: Complete the Online Application

Visit the UKVI website and start an entry clearance application (from outside the UK) or a leave to remain application (from inside the UK). Select the family visa, partner route. Complete all sections accurately and consistently with your supporting documents.

Step 3: Pay the Application Fee and IHS

Pay the visa application fee (£2,064 if applying outside the UK or £1,407 if applying inside the UK) and the Immigration Health Surcharge online (£3,105 if applying outside the UK or £2,587.50 if applying inside the UK).

Step 4: Biometric Appointment

Attend a UKVI visa application centre to provide fingerprints and a photograph. Book online and bring your confirmation letter and passport.

Step 5: Upload Supporting Documents

Scan and upload all supporting documents through the UKVI online portal before you attend your appointment. Label each document clearly.

Step 6: Submit and Wait

Submit the application. Standard processing takes approximately 12 weeks (outside UK) or 8 weeks (inside UK). Priority Services may be available at an additional cost. 

Extending Your Visa: FLR(M)

After the initial 2 years and 9 months, you must apply for a Further Leave to Remain  extension, known as FLR(M). This grants a further 2 years and 6 months of leave.

Extension requirements: the relationship must still be genuine and subsisting, the sponsor must still meet the financial requirement, the accommodation must still be adequate, the applicant must not be in breach of visa conditions, and the applicant must demonstrate English language ability at a higher level. 

Path to Settlement and Citizenship

The unmarried partner visa is a pathway visa leading to permanent settlement in the UK. The timeline under the current rules is as follows:

  • Months 0–33 (Initial visa): Arrive on an unmarried partner visa valid for 2 years 9 months. You can work, study, and access the NHS.
  • Month 33 (Extension): Apply for FLR(M). If granted, receive a further 2 years 6 months of leave.
  • After 5 years Apply for ILR: Apply for Indefinite Leave to Remain. Requirements include continuous residence, Life in the UK test, English at CEFR B1, and good character.
  • After Citizenship: If married to a British citizen, apply for British citizenship through naturalisation after ILR.

What to Do If Your Application Is Refused

Common refusal grounds include: insufficient evidence that the relationship is genuine and akin to marriage; the financial requirement not met; English language requirement not met; or accommodation inadequate.

Administrative review: If the decision-maker made an error in applying the rules, request an administrative review within 28 days.

Reapplication: Address the specific reasons for refusal and submit a fresh application with stronger evidence.
