How to Make an Indian Power of Attorney in the UK (2026)

Creating an Indian Power of Attorney from the UK involves three stages: drafting, execution in the UK, and legalisation for use in India.

Stage 1 — Drafting

The POA must be drafted under Indian law, not English law. A document prepared solely under UK legal conventions will not be accepted by Indian authorities. The draft should specify the powers being granted, identify the principal and attorney by full name and address, and reference any property or matter by its full legal description.

Stage 2 — Execution in the UK

You sign the POA in the presence of a UK Notary Public and two independent witnesses. The witnesses must not be related to you or benefit from the document. The Notary prepares a Notarial Certificate confirming your identity and the witnessed signature. The signed and notarised POA is attested by the High Commission of India or apostilled by the UK Foreign, Commonwealth and Development Office (FCDO).

Stage 3 — Registration

Once legalised in the UK, the document is presented for adjudication and, where required, registration in India by the attorney acting on your behalf.

FCDO Apostille & HCI Attestation for Indian Power of Attorney

An Indian Power of Attorney executed in the UK must be attested or apostilled before Indian authorities will accept it. Without the apostille, the Sub-Registrar’s office in India will not stamp or register the document.

What is an apostille?

An apostille is a certificate issued under the Hague Convention that authenticates the Notary Public’s signature on your document. India and the UK are both parties to the Hague Convention, which means an apostille issued by the UK is recognised in India without further embassy attestation.

How to get the apostille

After your POA has been signed and notarised, submit the original document to the UK Foreign, Commonwealth and Development Office (FCDO) for apostille. The FCDO charges £45 per document. Standard processing takes 15 to 20 working days. Expedited services are available through third-party legalisation agents for an additional fee.

What is attestation?

Attestation is provided by the High Commission of India, which is the Indian Emabassy based in the UK. You may choose to have your Power of Attorney attested by the HCI, rather than the apostille, however in some scenarios an apostille may be mandatory before the HCI attests your document.

Do you still need Indian Embassy attestation?

Since India acceded to the Hague Convention, the apostille alone is sufficient. You do not need to visit the Indian High Commission or VFS Global for attestation. That said, some local Sub-Registrar offices in India may request embassy counter-attestation as an additional step. If your attorney in India advises that the local office requires it, the Indian High Commission in London provides counter-attestation of apostilled documents.

What Happens After Your Power of Attorney Reaches India?

Once your UK legalised POA arrives in India, your attorney or representative must complete two steps before the document can be used.

Step 1 — Adjudication and Stamp Duty

The POA must be submitted to the District Collector or Sub-Registrar’s office for adjudication within three months of notarisation. Stamp duty is payable at this stage. The amount varies by state. 

Step 2 — Registration (for Property Sale POAs)

If the Power of Attorney authorises the sale or transfer of immovable property, it must be registered at the Sub-Registrar’s office where the property is located. The Supreme Court of India has ruled that registration is mandatory in these cases. Your attorney in India must attend the Sub-Registrar’s office in person. You, as the principal, do not need to be present in India.

For POAs that do not involve property sale (for example, financial management or legal representation), registration is strongly recommended but under the Indian Registration Act 1908.
