These Terms and Conditions govern the “PAN Application Services” provided by Whytecroft Ford, including: the (Foreign Citizen) NRI PAN Full Assistance application service; New PAN, Existing PAN, and OCI PAN application service-related information and services ordered from us through our Website (https://www.whytecroftford.com); and services ordered from us other than through our Website. To the extent that these terms and conditions relate to services ordered from us through the Website or otherwise, they shall be referred to as the “Full Assistance PAN Card Service Terms and Conditions”. These Terms and Conditions, together with the Website Terms of Use, shall be referred to as the “Terms and Conditions”.
You should understand that by using this Website you agree to be bound by the Terms and Conditions, and by ordering any of our services through the Website or otherwise you agree to be bound by the Terms and Conditions.
Please read these legally binding documents carefully. If you disagree with the Terms of Use, you must not use our Website; and if you disagree with the Terms and Conditions, you must not order services through the Website or otherwise. Please understand that if you refuse to accept these Terms of Use and Terms and Conditions, you will not be able to purchase any services from us.
These Terms and Conditions are in the English language only. You should retain a copy of these Terms and Conditions for future reference.
Whytecroft Ford is a specialised legal services provider that also sells individual legal and business documents, and guides related to legal documents, to be used in India under Indian law. We provide legal and business Guide(s), services and templates; it is the responsibility of the customer to ensure that the Guide or document packs purchased from us meet their individual requirements.
These Terms and Conditions apply to both Paid Services and other related Services provided by Whytecroft Ford.
The documents, document packs, forms, information, Guides and/or material purchased from Whytecroft Ford do not constitute, and are not intended to replace, legal advice. We strongly recommend that proper legal advice is sought where the customer is unsure about the appropriateness or legal aspects of any document, form, information or material purchased from us.
Liability
Whytecroft Ford uses its best endeavours to ensure that all documents, forms, information and material contained within its Website are correct and reflect the current law. We will try to rectify any errors within a reasonable time.
Whytecroft Ford, its directors and employees will not be held liable for any loss or damage of any kind arising from the use or inability to use this Website and the documents, forms, information and material purchased from us, or where the customer relies on the information contained within this Website.
No liability shall attach to Whytecroft Ford, its directors and employees for any loss or damage of any kind suffered as a result of errors or omissions in the contents of any documents, forms, information and material contained within this Website.
It is the responsibility of the customer to ensure that any document, form, information and material purchased from us is appropriate for its intended purpose. We do not warrant that the documents, forms, information and material purchased from us will be fit for their intended purpose.
The documents, document packs and information contained in this Website do not constitute legal advice. We therefore strongly recommend that you seek proper legal advice when using our services.
Our Full Assistance PAN Card Application Service fee does not include additional costs. You are responsible for other costs, such as photographs, postage, and similar items, payable directly by you to your selected service provider.
Our service does not in any way replace or supersede the official guidelines or requirements set out by the Government of India, Income Tax Department, nor does the service act on behalf of, or is affiliated with, any of the aforementioned official bodies. The service is not endorsed in any way whatsoever by any of the official bodies. Whytecroft Ford does not act as a “representative” on your behalf. Whytecroft Ford is not a “Depository Participant” as specified by the Government of India. Our level of involvement in this service is as follows: assistance in the application process from start to finish using the designated official PAN portal(s), including guiding you through the specific legal requirements, preparing your documentary evidence portfolio, completing your application form on your behalf online with your permission, and guiding you through the process of final submission to the official designated body. Additional information and/or documentation based on your circumstances may be requested by us where required.
There are only two officially authorised/designated online portals (also known as companies) that accept online PAN applications for Overseas Citizens (Protean eGov and UTIITSL), as per the Income Tax Department, Government of India.
This service is for Form 95 (formerly Form 49AA) for Foreign Citizen/Foreign Passport holder, based on Applicant Type – Individual: preparation and assistance with PAN application online in a supplementary capacity.
Suitability of use of the service is at the sole discretion of the applicant. Approval of the allotment of PAN is solely under the jurisdiction of the Income Tax Department, Government of India, and its designated bodies. Whytecroft Ford Ltd maintains no responsibility for the allotment of NRI (Foreign Citizen/OCI) PAN, and our services and/or advice serve in a supplementary and preparatory capacity (only) between the applicant and the aforementioned official bodies. The final decision on PAN allotment remains under the approval of the Income Tax Department, Government of India. Our service is not a substitute for professional advice via the designated official bodies or their official representatives and associated companies.
Eligibility for Use of Service
This service is for an (individual) Foreign Citizen (a non-Indian passport holder) who requires an Indian PAN Card (under the new PAN 2.0 update), as set out within the parameters of the Government of India. The applicant confirms their understanding of the process to apply, and further confirms that no PAN card has been applied for by them within the last 30 days of confirming our service, and that they do not hold an existing PAN Card. The same applies to any other eligibility complications coming to our awareness which would render this service unsuitable. If you do not meet the eligibility criteria and have made payment in full for the service via our Website, you will be informed and a full refund will be issued, less a £10 administrative cost. You will be duly notified. Eligibility checks will be carried out prior to any work commencing on the service. This service is based on updates to the publicly available rules and regulations of the official authorities.
Multiple PAN Applicants
Where one individual is communicating on behalf of other applicants, you confirm that the other applicants are duly informed of the process of our services, and that the other applicants specified by you have authorised you to communicate with our firm on their behalf for the purpose of their PAN applications. All personal information required from the other applicants, as requested by our firm for the process of their PAN application preparation, will be solely the responsibility of the main service buyer. The Terms and Conditions set out here apply to all (individual) applicants detailed in the confirmation and engagement of our service. You may be asked to provide a consent authorisation form signed by the other applicants in order for us to commence the service on their behalf.
Our Fee
Our fee is fixed and non-refundable, based on a per-applicant, per-application basis; no VAT is charged. Unless otherwise stated in writing. Payment of the fee must be made upfront for the service engagement. Third-party costs not included.
Terminology
The terms “Overseas Citizen”, “Overseas Indian”, “Foreign Citizen” and “NRI” are used colloquially/interchangeably in these terms for a non-Indian passport holder. However, the legal technical definitions of these terms will be applied based on the Indian Government’s official categorisations for the purpose of the PAN application process.
Waiver
The failure by Whytecroft Ford to enforce at any time, or for any period, any one or more of these Terms and Conditions shall not be a waiver of them, or of the right at any time subsequently to enforce all Terms and Conditions.
Severance
If any provision of these Terms and Conditions is found by any court to be invalid or unenforceable, such invalidity or unenforceability shall not affect the other provisions of these Terms and Conditions, which shall remain in full force and effect.
If any provision of these Terms and Conditions is found to be invalid or unenforceable, but would be valid or enforceable if some part of the provision were deleted, the provision in question shall apply with such modification(s) as may be necessary to make it valid and enforceable.
Services
We endeavour to provide a high-quality service. With this in mind, we provide telephone and email support with this service. In the event that your application cannot be serviced by us, a full refund will be provided back to the original mode of payment made by you, less an administrative cost of £10.00. You will be notified immediately of the same.
Complaints & Refunds
Under Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (formerly Consumer Protection (Distance Selling) Regulations 2000), there is no right of refund or cancellation once a document or a document pack has been purchased. However, if you are dissatisfied with your purchase, please contact us. We do our best to ensure that all complaints are dealt with within 24 hours; if you have a complaint, please contact us at info@whytecroftford.com.
Our fees are non-refundable and are payable before commencement of work on your application. No VAT will be charged. You will be responsible for other costs, such as the photographs, postage, HCI appointments where required, and similar items, payable directly by you to your selected service provider.
By purchasing this service, the client acknowledges and agrees that it is their sole responsibility to provide all necessary requirements and documentation within the designated timeframe (30 days from service engagement). In the event that the client fails to meet these obligations, no refunds will be issued, and the client accepts full responsibility for any resultant delays or issues.
Jurisdiction and Governing Law
These Terms and Conditions shall be governed by and construed in accordance with English law. Any dispute, claim or matter arising out of, or relating to, these Terms and Conditions shall be subject to the exclusive jurisdiction of the English courts.
