UK Partner Visa: Spouse, Civil Partner, Unmarried Partner or Fiancé?

A UK partner visa application falls into one of four categories: spouse, civil partner, unmarried partner, or fiance(e) and proposed civil partner. Which category applies depends on the couple’s relationship, and each carries its own rule on eligibility and on where the application can be made. An application prepared against the wrong category may be refused, even where the underlying relationship would otherwise qualify. What framework governs UK partner visa relationship types?

Appendix FM of the Immigration Rules governs every UK partner visa category. GEN.1.2 defines “partner” as one of four relationship types: a spouse, a civil partner, or a fiance(e) or proposed civil partner. The fourth is a person in a relationship similar to marriage or civil partnership with the sponsor for at least two years.

Who is a spouse under Appendix FM?

A spouse is an applicant who is legally married to their sponsor, under a marriage recognised as valid in the country where it took place.

This test sits at E-ECP.2.7 of Appendix FM for entry clearance, and E-LTRP.1.8 for leave to remain. No minimum length of marriage is set by the Rules before an application can be made. Who is a civil partner under Appendix FM?

A civil partner is an applicant who is in a civil partnership with their sponsor, recognised as valid under the same test applied to marriages.

This test also sits at E-ECP.2.7 and E-LTRP.1.8 of Appendix FM, applied to civil partnerships rather than marriages. Who is an unmarried partner under Appendix FM?

An unmarried partner is an applicant who has been in a relationship similar to marriage or civil partnership with their sponsor. This relationship must have lasted at least two years before the date of application.

This test sits at E-LTRP.1.7 and E-ECP.2.10 of Appendix FM. The two years usually, but does not always, involve living together throughout. Any period spent apart, for example because of work or study, is compatible provided the relationship remains similar to a marriage or civil partnership. Same-sex and opposite-sex couples qualify equally, since GEN.1.2 does not limit the category by sex. Who is a fiancé(e) or proposed civil partner under Appendix FM?

A fiance(e) or proposed civil partner is an applicant seeking entry to the UK to marry or register a civil partnership with their sponsor.

This defining feature sits at E-ECP.2.8 of Appendix FM. Neither party can hold another subsisting marriage or civil partnership at the date of application, under E-ECP.2.9. This category can only be applied for from outside the UK. Under E-LTRP.1.12, it is not available as a first application from within the UK. Leave granted on this route runs for up to six months, with no permission to work. A person who already holds fiance(e) leave may get a further period of up to six months under E-LTRP.1.11. This applies where the marriage has not yet taken place for good reason. This only extends existing leave. It does not let the category be originated in-country. An unmarried partner who becomes engaged during their visa period should extend their application in the unmarried partner category. Switching to fiance(e) status is not the correct next step, since the two-year relationship test already met does not apply to a fiance(e) application.

Who can sponsor a partner visa application?

The sponsor, the person the applicant is joining or remaining with in the UK, must meet one of six defined categories. For entry clearance, these sit at E-ECP.2.1 of Appendix FM. For an application for leave to remain, the equivalent list sits at E-LTRP.1.2. The sponsor must be:

  • a British citizen in the UK;
  • otherwise present and settled in the UK;
  • present in the UK with protection status;
  • present in the UK with limited leave under Appendix EU;
  • present in the UK with limited leave as a worker or business person under the Appendix ECAA Extension of Stay; or
  • present in the UK with permission as a stateless person.

An application assessed against the wrong sponsor category is measured against a requirement the sponsor does not actually meet. Confirming which of the six limbs applies comes before any other part of the application.

Can I apply for a UK partner visa from inside the UK?

The spouse, civil partner, and unmarried partner categories can each be applied for from outside the UK, as an entry clearance application. They can also be applied for from inside the UK, as an application for leave to remain, provided the applicant holds a qualifying status.

The fiance(e) or proposed civil partner category is different: a first application can only be made from outside the UK. A person already in the UK on fiance(e) leave can extend that leave in-country under E-LTRP.1.11. That person cannot use this route to originate the category from inside the UK for the first time.

FAQs

What happens if I get engaged to my partner after we have already met the two-year relationship test?

The unmarried partner category continues to apply. Becoming engaged does not convert an application into the fiance(e) category. Switching to fiance(e) status is not the correct step once the two-year relationship test is already met.

Does my partner, the sponsor, have to be a British citizen for me to apply?

Not necessarily. A British citizen sponsor is one of six defined sponsor categories. A sponsor may instead be settled in the UK, or hold protection status. Other options are limited leave under Appendix EU, or permission as a worker or business person under the Appendix ECAA Extension of Stay. A sponsor may also hold permission as a stateless person.

Can I switch from a fiance(e) visa to a spouse visa without leaving the UK?

Yes, once the marriage or civil partnership has taken place. The switch is made from inside the UK, under the standard spouse or civil partner route, which carries the right to work and study.

Is the unmarried partner category available to same-sex couples?

Yes. GEN.1.2 defines the unmarried partner category without reference to sex, so the same two-year relationship test applies equally to same-sex and opposite-sex couples.

A previous visa application was refused. Does that rule out a partner visa application?

Not necessarily. A standard visitor visa refused for someone visiting a UK-based spouse, for example, does not prevent a fresh spouse visa application. A fresh application, prepared against the correct category’s requirements, may be the more appropriate route.
