On 29 September 2025, the Home Secretary announced a proposed new contribution-based settlement model to reduce net migration. Applicants would generally need to have been lawfully resident in the UK for 10 years, double the current five-year standard, unless they meet higher thresholds. According to the announcement, people could earn a reduction in the number of years if they meet earnings or integration requirements, but those who have been non-compliant will either face a longer wait or risk refusal.
The Home Secretary set out the proposed conditions for gaining indefinite leave to remain in the UK, including being in work, making a certain level of National Insurance contributions, not taking any benefits payments, learning English to a high standard, having a spotless criminal record, and giving back by, for example, working in your local community.
Who will be affected and when could changes take effect?
The government plans to launch a public consultation later in 2025 to flesh out the details. However, the uncertainty around the timing and scope of these changes creates risk for those nearing ILR eligibility under current rules. For many migrants, applying now may be strategically safer than waiting for the new regime. The plans will be subject to a consultation, which will be launched by the end of the year and will be open to contributions from the public.
Why act now if you already qualify under current rules?
If you currently meet all the criteria for ILR under the existing five-year route, applying now means you can avoid being subject to the stricter contribution-based rules. Once the new model comes into force, new applicants may need to satisfy additional “earned contribution” tests and wait longer.
