UK Spouse Visa Accommodation Letter From a Landlord

A UK Spouse Visa application must sufficiently demonstrate where the couple will live once the applicant arrives. Where the sponsor rents, that evidence may include a brief letter from the landlord or an estate agent confirming the tenancy and consenting to the applicant living there. This post sets out what the letter must confirm, who should sign it, and what to send with it.

What the accommodation letter is for

The couple must show that they will have adequate accommodation in the UK, which they own or occupy exclusively, without recourse to public funds. This is the adequate accommodation requirement. It is demonstrated by evidence of the property, the right to live in it, and the number of occupants. The requirement is set out at E-ECP.3.4 of Appendix FM for an application made from outside the UK. The equivalent provision for switching to the partner route in the UK is E-LTRP.3.4.

Accommodation is not regarded as adequate if it is, or will be, overcrowded, or if it contravenes public health regulations. Both limbs are tested.

The sponsor lawfully occupies the property, and the landlord permits the applicant to live there too. A tenancy agreement often cannot show the second point, because it was signed when the sponsor lived there alone.

Who should sign the letter

The letter comes from the person with legal control of the property. In practice this falls into three situations.

A private landlord signs it where the sponsor rents from one. A letting agent signs it where the agent manages the property, and confirms they act for the landlord. A family member who owns the property signs it themselves.

An unsigned letter does not establish permission. Neither does one written by the sponsor about their own tenancy, because the sponsor cannot grant consent over a tenancy they hold.

What the letter must confirm

A landlord’s accommodation letter should confirm the following:

  • The property. The full address, including the postcode.
  • The landlord’s standing. That they own the property, or are the letting agent acting for the owner.
  • The tenancy. That the sponsor is the tenant, with the start date, and whether the tenancy is fixed term or periodic.
  • Its condition. That the tenancy is in good standing, meaning rent is up to date and no notice has been served by either party.
  • Consent. That the landlord permits the named applicant to live at the property, and from what date.
  • Occupancy. How many bedrooms the property has, and who currently lives there.

The ages of any children among the occupants should be given, because the overcrowding standards count children differently from adults. The landlord’s direct contact details should also appear, so the confirmation can be verified without a further request.

Form and dating

The letter carries no prescribed format under the Rules. Four practical points apply. It should be signed and dated by the person giving the confirmation. It should be on that person’s own letterhead or contact details, rather than presented as a document the couple has produced. It should address the six points above in plain terms, without adopting the language of the Rules. It should also be dated shortly before the application is submitted within 28 days of the intended date of application, so that it speaks to the tenancy as at the date of application.

Rooms in shared houses and houses in multiple occupation

Renting a room rather than a whole property does not prevent the requirement being met. The Rules require the family to own or occupy the accommodation exclusively. Exclusive occupation means that part of the accommodation must be for the exclusive use of the family. A couple with sole use of one bedroom can therefore satisfy it. The property must not be overcrowded once the applicant moves in.

The letter should do two extra things where the property is a house in multiple occupation. It should identify which room or rooms the couple will occupy exclusively. It should also confirm that the property is licensed, where a licence is required. Shared use of a kitchen or bathroom does not defeat exclusive occupation, and the letter need not claim otherwise.

Overcrowding in England and Wales is measured under the Housing Act 1985. Two standards apply, the room standard and the space standard. The room standard is contravened where two people must share a room to sleep. Both must be aged 10 or over, of the opposite sex, and not a couple. A room count and an occupant list allow that test to be applied on the papers.

What to send with the letter

The letter supports the other accommodation evidence rather than replacing it. A renting sponsor usually sends three items of evidence. These are the tenancy agreement in the sponsor’s name, the landlord’s letter, and recent proof of address such as council tax or utility bills.

An independent property inspection report is not required by the Rules. It is useful in two situations. The first is where the household is close to the overcrowding threshold. Frequently asked questions

Can the couple live in a single room in a shared house? Yes, provided part of the accommodation is for their exclusive use. The property must also not be overcrowded once the applicant moves in.

What if the tenancy agreement does not permit additional occupants? The landlord’s written consent addresses this. Where the agreement restricts occupancy, the letter should record that the landlord permits the applicant to reside there despite that term.

How recent should the letter be? It should be dated shortly before submission, so that it confirms the position as at the date of application.
