These terms and conditions govern the Electronic Guide (E-Guide), Paper Guides, related information and guidance services ordered from us through our Website (https://www.whytecroftford.com) and services ordered from us other than our Website (to the extent that these terms and conditions relate to services ordered from us through the website or otherwise such terms and conditions shall be referred to as “Guide Services Terms and Conditions” and these Terms and Conditions together with the Website Terms of Use shall be referred to as the “Terms and Conditions”). You should understand that by using this Website you agree to be bound by the Terms and Conditions and by ordering any of our services through the Website or otherwise you agree to be bound by the Terms and Conditions.
Please read these legally binding documents carefully. If you disagree with the Terms of Use you must not use our website and if you disagree with the Terms and Conditions you must not order services through the Website or otherwise. Please understand that if you refuse to accept these Terms of Use and Terms and Conditions, you will not be able to purchase any services from us.

Whytecroft Ford is a specialised legal services provider that also sells individual legal, business documents and guides all related to legal documents to be used in India under Indian Law. We provide legal and business Guide(s), services and templates, it is the responsibility of the customer to ensure that the Guide or document packs purchased from us meet your individual requirements.
These Terms and Conditions apply to both Paid Guide Services and Free Guide Services provided by Whytecroft Ford.
The documents, document packs, forms, information, Guides and/or material purchased from Whytecroft Ford do not constitute and are not intended to replace legal advice. We strongly recommend that proper legal advice is to be sought where the customer is unsure about the appropriateness or legal aspects of a document, form, information and material purchased from us.
Liability
Whytecroft Ford uses its best endeavours to ensure that all documents, forms, information and material contained within its website are correct and reflect the current law. We will try to rectify any errors within a reasonable time.
Whytecroft Ford, its directors and employees will not be held liable for any loss or damage of any kind arising from the use or inability to use this website and the documents, forms, information and material purchased from us, or where the customer relies on the information contained within this website.

Waiver
The failure by Whytecroft Ford to enforce at any time or for any period any one or more of the terms and conditions shall not be a waiver of them or the right at any time subsequently to enforce all terms and conditions.
Severance
If any provision of these terms and conditions shall be found by any court to be invalid or unenforceable, such invalidity or unenforceability shall not affect the other provisions of these terms and conditions which shall remain in full force and effect.
If any provision of these terms and conditions is so found to be invalid or unenforceable but would be valid or enforceable if some part of the provision were deleted, the provision in question shall apply with such modification(s) as may be necessary to make it valid and enforceable.
Terminology
A Guide is a set of information presented in form of a book under 100 pages. It can be in paper book form (physical) or electronic form (E-Guide).
An E-Guide, stands for “electronic guide” is a set of information presented in form of a book under 100 pages viewable on an electronic device. The format of an E-Guide maybe in PDF, Word or of a simialr nature. An E-Guide may offer user friendly viewing options such as mobile, ipad, desktop.
Guide(s) Services are all services included in a Guide.
Purpose
A Guide, is a set of information presented in form of a book under 100 pages. The Guide may include steps on how to carry out a necessary set of actions for a specific subject with an end purpose. A Guide works in the capacity of support or assistance on a particular subject.
Disclaimer
The Guide does not in anyway replace or supersede the official guidelines or requirements as set out by the Government of India, Income Tax Department. Neither does the E-Guide act on behalf of any of the former official bodies. The E-Guide is not endorsed in anyway whatsoever by any of the detailed official bodies. The E-Guide is a supplementary step by step descriptive set of information that intends to offer assistance in applying for (Form 49AA) Foreign Citizen, Overseas Citizen, NRI PAN online via the Protean eGov portal (self directed) only. The E-Guide is based on expertise namely, applications that have been successfully prepared for submission by Whytecroft Ford using Protean eGov only. Suitability of use of the E-Guide is at the sole discretion of the applicant. The E-Guide is a paid service provided by our firm. Approval in the allotment of PAN is solely under the jurisdiction of Income Tax Department Government Of India and its designated bodies. Whytecroft Ford Ltd maintains no responsibility in allotment of NRI PAN and our services or advise serve in a supplementary and preparatory capacity (only) between applicant and the said mentioned official bodies. The final decision of PAN allotment remains under the approval of the Income Tax Department, Government of India. The E-Guide is updated as and when required incoherence with the official bodies. The E-guide is not a substitute for professional advice and should be used in an informative capacity only. Examples 1A to 6A are simulated screen examples of the online application process; all rights remain with the original owner. For the purpose of the E-Guide, the applicant details provided in the E-Guide’s online PAN card application example sections are used in a fictitious manner and are based on dummy details, including name, address, contact and all associated applicant details. Any resemblance to actual persons, living or dead, or actual events is purely coincidental.
Guide Services
We endeavour to provide a high-quality service. Keeping this in mind, we provide email support with most of our Guides. We reserve the right to refuse email support where it exceeds the allowed threshold with exceptions. A Guide is self limiting and by way of purchase of a Guide it is understood that it is a self directed service.
Complaints & Refunds
Under Regulation 13 of the Consumer Protection (Distance Selling) Regulations 2000 there is no right of refund or cancellation once a document or a document pack has been purchased. Jurisdiction and Governing Law
These terms and conditions shall be governed by and construed in accordance with English law. Any dispute, claim or matter arising out of, or relating to, these terms and conditions shall be subject to the exclusive jurisdiction of the English courts.
